Ob\u010dianskeho z\u00e1konn\u00edka SR (\u010falej ako <strong>\u201eOb\u010diansky z\u00e1konn\u00edk\u201c<\/strong> alebo <strong>\u201eOZ\u201c<\/strong>), pod\u013ea ktor\u00fdch pri pred\u010dasnej splatnosti sa nezoh\u013ead\u0148uje proporcionalita tohto \u00fakonu, najm\u00e4 z\u00e1va\u017enos\u0165 poru\u0161enia povinnosti spotrebite\u013eov v\u00a0pomere k\u00a0v\u00fd\u0161ke \u00faveru a\u00a0dobe jeho spl\u00e1cania.<\/p>\n<p>Pod\u013ea \u00a7\u00a053 ods.\u00a09 Ob\u010dianskeho z\u00e1konn\u00edka m\u00f4\u017ee verite\u013e v\u00a0pr\u00edpade zmluvy o\u00a0spotrebite\u013eskom \u00favere spl\u00e1canom v\u00a0spl\u00e1tkach po\u017eiada\u0165 o\u00a0zaplatenie cel\u00e9ho \u00faveru v\u00a0s\u00falade s\u00a0\u00a7\u00a0565 tohto z\u00e1konn\u00edka, ak sa na tom dohodli zmluvn\u00e9 strany. Verite\u013e si m\u00f4\u017ee uplatni\u0165 toto pr\u00e1vo najsk\u00f4r tri mesiace od ome\u0161kania so zaplaten\u00edm spl\u00e1tky a\u00a0po upovedomen\u00ed spotrebite\u013ea minim\u00e1lne p\u00e4tn\u00e1s\u0165 dn\u00ed vopred.<\/p>\n<p>N\u00e1sledne je mo\u017en\u00fd postup pod\u013ea z\u00e1kona \u010d. 233\/1995 Z. z. o s\u00fadnych exek\u00fatoroch a exeku\u010dnej \u010dinnosti (Exeku\u010dn\u00fd poriadok), v\u00a0zmysle ktor\u00e9ho mo\u017eno za podmienok uveden\u00fdch v \u00a7 63 ods. 3 a\u00a04 vykona\u0165 exek\u00facie predajom nehnute\u013enosti a\u00a0to u\u017e pri poh\u013ead\u00e1vke prevy\u0161uj\u00facej 2000,- Eur, alebo postup pod\u013ea \u00a7 16 a\u00a0nasl. z\u00e1kona \u010d. 527\/2002 Z. z. o\u00a0dobrovo\u013en\u00fdch dra\u017eb\u00e1ch.<\/p>\n<p>S\u00fadny dvor sa v\u00a0prvom rade musel vysporiada\u0165 s\u00a0ot\u00e1zkou, \u010di klauzula o\u00a0pred\u010dasnom splaten\u00ed \u00faveru definovan\u00e1 v\u00a0zmluve o\u00a0\u00favere tak, ako ju upravuje Ob\u010diansky z\u00e1konn\u00edk, spad\u00e1 do re\u017eimu Smernice Rady 93\/13\/EHS z\u00a05. apr\u00edla 1993 o\u00a0nekal\u00fdch podmienkach v\u00a0spotrebite\u013esk\u00fdch zmluv\u00e1ch (\u010falej aj ako <strong>\u201eSmernica 93\/13\u201c<\/strong>) a\u00a0teda, \u010di mo\u017eno t\u00fato podmienku pos\u00fadi\u0165 ako nekal\u00fa. Toti\u017e pod\u013ea \u010dl. 1 ods. 2 tejto smernice, <em>\u201ezmluvn\u00e9 podmienky, ktor\u00e9 odr\u00e1\u017eaj\u00fa <strong>z\u00e1v\u00e4zn\u00e9 z\u00e1konn\u00e9<\/strong> alebo regula\u010dn\u00e9 ustanovenia &#8230; nepodliehaj\u00fa ustanoveniam tejto smernice\u201c<\/em>.<\/p>\n<p>Pri posudzovan\u00ed podmienky \u201ez\u00e1v\u00e4znosti\u201c \u00a7 53 ods. 9 Ob\u010dianskeho z\u00e1konn\u00edka v\u0161ak S\u00fadny dvor dospel k\u00a0z\u00e1veru, \u017ee t\u00e1to podmienka nie je splnen\u00e1, nako\u013eko ide o\u00a0ustanovenie, ktor\u00e9 nem\u00e1 kogentn\u00fa povahu a\u00a0pod\u013ea \u00a7 54 ods. 1 OZ sa od neho mo\u017eno odch\u00fdli\u0165 v\u00a0prospech spotrebite\u013ea (body 69-71 Rozsudku).<\/p>\n<p>S\u00fadny dvor n\u00e1sledne uviedol, \u017ee slovensk\u00e9 vn\u00fatro\u0161t\u00e1tne s\u00fady <strong>musia posudzova\u0165 aj proporcionalitu<\/strong> zmluvnej klauzuly prizn\u00e1vaj\u00facej verite\u013eovi pr\u00e1vo po\u017eadova\u0165 splatenie celej dl\u017enej sumy, \u010do znamen\u00e1, \u017ee musia zoh\u013eadni\u0165 najm\u00e4 z\u00e1va\u017enos\u0165 nesplnenia zmluvn\u00fdch povinnost\u00ed zo strany spotrebite\u013ea, ak\u00fdmi s\u00fa v\u00fd\u0161ka nezaplaten\u00fdch spl\u00e1tok vo vz\u0165ahu k\u00a0celkovej v\u00fd\u0161ke \u00faveru a\u00a0k\u00a0d\u013a\u017eke trvania zmluvy.<\/p>\n<p>V\u00a0posudzovanom pr\u00edpade tak s\u00fady bud\u00fa musie\u0165 vykona\u0165 test proporcionality pos\u00faden\u00edm nasledovn\u00fdch skuto\u010dnost\u00ed:<\/p>\n<ul>\n<li>i\u0161lo o\u00a0zmluvu o\u00a0spotrebite\u013eskom \u00favere so V\u0161eobecnou \u00faverovou bankou a.s.<\/li>\n<li>splatnos\u0165 \u00faveru bola dohodnut\u00e1 na 20 rokov<\/li>\n<li>banka si uplatnila klauzulu o\u00a0pred\u010dasnom splaten\u00ed menej ako po roku trvania zmluvy<\/li>\n<li>neuhraden\u00e9 spl\u00e1tky predstavovali sumu 1106,50 Eur<\/li>\n<li>hodnota rodinn\u00e9ho domu, ktor\u00fd je predmetom dobrovo\u013enej dra\u017eby je najmenej tridsa\u0165kr\u00e1t vy\u0161\u0161ia ako suma, pre ktor\u00fa V\u00daB vyhl\u00e1sila pred\u010dasn\u00fa splatnos\u0165 \u00faveru a\u00a0prist\u00fapila k\u00a0v\u00fdkonu z\u00e1lo\u017en\u00e9ho pr\u00e1va.<\/li>\n<\/ul>\n<p>V\u00a0kontexte tohto rozhodnutia S\u00fadneho dvora by tak vn\u00fatro\u0161t\u00e1tne s\u00fady mali v\u017edy individu\u00e1lne posudzova\u0165 legitimitu zmluvnej podmienky o\u00a0pred\u010dasnom splaten\u00ed cel\u00e9ho \u00faveru, a\u00a0to prostredn\u00edctvom vykonan\u00e9ho testu proporcionality. \u0160koda len, \u017ee S\u00fadny dvor neposkytol verite\u013eom konkr\u00e9tnej\u0161ie vod\u00edtka ako pred uplatnen\u00edm tejto zmluvnej klauzuly postupova\u0165, napr\u00edklad stanoven\u00edm konkr\u00e9tnej\u0161\u00edch krit\u00e9ri\u00ed, kedy e\u0161te je mo\u017en\u00e9 zmluvn\u00fa podmienky pova\u017eova\u0165 za prijate\u013en\u00fa a\u00a0kedy naopak, za nekal\u00fa.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; Pred nieko\u013ek\u00fdmi d\u0148ami sa S\u00fadny dvor E\u00da vyjadril k\u00a0ot\u00e1zke mo\u017enej nekalej podmienky zmluvy o spotrebite\u013eskom \u00favere zabezpe\u010denom nehnute\u013enos\u0165ou sl\u00fa\u017eiacou ako rodinn\u00e9 obydlie.
