Zamestn\u00e1vate\u013e v\u0161ak nieko\u013ek\u00fdm svojim obchodn\u00fdm partnerom ozn\u00e1mil, \u017ee skuto\u010dn\u00fdm d\u00f4vodom rozviazania pracovn\u00e9ho pomeru so zamestnancom (\u017ealobcom) bolo opakovan\u00e9 poru\u0161enie pracovnej discipl\u00edny z\u00a0d\u00f4vodu v\u00fdkonu pr\u00e1ce pod vplyvom alkoholu.<\/p>\n<p>Okresn\u00fd s\u00fad odmietol vykona\u0165 d\u00f4kaz navrhnut\u00fd zamestn\u00e1vate\u013eom (\u017ealovanou), konkr\u00e9tne v\u00fdsluch svedkov, ktor\u00ed mali dosved\u010di\u0165, \u017ee \u017ealobcu musel nieko\u013ekokr\u00e1t zastupova\u0165 v\u00a0pr\u00e1ci in\u00fd kolega, a\u00a0to pr\u00e1ve z\u00a0d\u00f4vodu po\u017eitia alkoholu. Pod\u013ea prvostup\u0148ov\u00e9ho s\u00fadu bol tak\u00fdto d\u00f4kaz irelevantn\u00fd, preto\u017ee \u017eiadny pr\u00e1vny predpis neur\u010duje \u017ealovanej povinnos\u0165 zdie\u013ea\u0165 s\u00a0in\u00fdmi subjektami inform\u00e1cie o\u00a0pracovnej discipl\u00edne zamestnancov.<\/p>\n<p>Odvolac\u00ed s\u00fad prvostup\u0148ov\u00fd rozsudok potvrdil, pri\u010dom uviedol, \u017ee tvrdenie \u017ealovanej \u017ee \u201ena\u0161a spolo\u010dnos\u0165 musela ukon\u010di\u0165 spolupr\u00e1cu s p\u00e1nom G. L., d\u00f4vodom bolo opakovan\u00e9 hrub\u00e9 poru\u0161enie pracovnej discipl\u00edny (probl\u00e9my s alkoholom)\u201c je skutkov\u00fdm tvrden\u00edm sp\u00f4sobil\u00fdm zasiahnu\u0165 do pr\u00e1va \u017ealobcu na jeho \u010des\u0165 a\u00a0dobr\u00fa poves\u0165. Pod\u013ea odvolacieho s\u00fadu <em>\u201eV z\u00e1sade plat\u00ed, \u017ee pravdiv\u00e1 inform\u00e1cia nezasahuje do pr\u00e1va na ochranu osobnosti, pokia\u013e tento \u00fadaj nie je podan\u00fd sp\u00f4sobom, \u017ee skres\u013euje skuto\u010dnos\u0165, \u010di nie je nato\u013eko int\u00edmny, \u017ee by odporoval pr\u00e1vu na ochranu s\u00fakromia a \u013eudskej d\u00f4stojnosti.\u201c<\/em><\/p>\n<p>Pravdivos\u0165 (objekt\u00edvnos\u0165) skutkov\u00e9ho tvrdenie \u017ealovanej o\u00a0probl\u00e9moch \u017ealobcu s\u00a0alkoholom v\u0161ak pod\u013ea odvolacieho s\u00fadu mo\u017eno dostato\u010dne overi\u0165 (preuk\u00e1za\u0165) u\u017e predlo\u017een\u00fdm d\u00f4kazom &#8211; dohodou o skon\u010den\u00ed pracovn\u00e9ho pomeru medzi stranami sporu, ktor\u00e1 bola uzatvoren\u00e1 \u201ebez uvedenia d\u00f4vodu\u201c skon\u010denia pracovn\u00e9ho pomeru. Z tohto skutkov\u00e9ho zistenia potom pod\u013ea krajsk\u00e9ho s\u00fadu vyvodil s\u00fad prvej in\u0161tancie spr\u00e1vny z\u00e1ver, \u017ee ozna\u010den\u00e9 sporn\u00e9 skutkov\u00e9 tvrdenie sa nezaklad\u00e1 na pravde a\u00a0preto vykonanie v\u00fdsluch svedkov navrhnut\u00fdch \u017ealovanou je irelevantn\u00e9.<\/p>\n<p>In\u00fdmi slovami, na preuk\u00e1zanie skuto\u010dn\u00e9ho d\u00f4vodu skon\u010denia pracovn\u00e9ho pomeru, a\u00a0teda aj na preuk\u00e1zanie (ne)pravdivosti skutkov\u00fdch tvrden\u00ed o\u00a0probl\u00e9moch s\u00a0alkoholom na pracovisku, je podstatn\u00e1 prakticky len dohoda o\u00a0skon\u010den\u00ed pracovn\u00e9ho pomeru a\u00a0d\u00f4vod skon\u010denia v\u00a0nej uveden\u00fd. A\u00a0ke\u010f\u017ee dohoda o\u00a0skon\u010den\u00ed pracovn\u00e9ho pomeru z\u00e1va\u017en\u00e9 poru\u0161enie pracovnej discipl\u00edny z\u00a0d\u00f4vodu po\u017eitia alkoholu nekon\u0161tatovala, konanie \u017ealovanej je sp\u00f4sobil\u00e9 zasiahnu\u0165 do pr\u00e1v na ochranu osobnosti \u017ealobu.<\/p>\n<p>Najvy\u0161\u0161\u00ed s\u00fad sa v\u0161ak s\u00a0rozhodnut\u00edm s\u00fadom ni\u017e\u0161ej in\u0161tancie nestoto\u017enil a uviedol, \u017ee absencia d\u00f4vodu skon\u010denia pracovn\u00e9ho pomeru v\u00a0dohode o\u00a0jeho skon\u010den\u00ed (ktor\u00fd vo v\u0161eobecnosti ani nemus\u00ed by\u0165 v\u00a0dohode uveden\u00fd) <em>\u201e<\/em><em>neznamen\u00e1, \u017ee absencia tak\u00e9hoto d\u00f4vodu m\u00e1 absol\u00fatny vplyv na pravdivos\u0165 skutkov\u00e9ho tvrdenia (ozn\u00e1menia), \u017ee pracovn\u00fd pomer so \u017ealobcom bol ukon\u010den\u00fd pre jeho probl\u00e9my s alkoholom. Neuveden\u00edm tejto okolnosti do d\u00f4vodov dohody o rozviazan\u00ed pracovn\u00e9ho pomeru sa s\u00edce vystavila \u017ealovan\u00e1 strana v\u00e4\u010d\u0161ej d\u00f4kaznej n\u00fadzi, t\u00fato je ale mo\u017en\u00e9 odstr\u00e1ni\u0165, pr\u00edpadne aj \u0148ou navrhnut\u00fdmi d\u00f4kazmi (d\u00f4kazn\u00e9 bremeno za\u0165a\u017euje \u017ealovan\u00fa).\u201c<\/em><\/p>\n<p>Pod\u013ea n\u00e1zoru najvy\u0161\u0161ieho s\u00fadu neuvedenie d\u00f4vodu skon\u010denia pracovn\u00e9ho pomeru v dohode o rozviazan\u00ed pracovn\u00e9ho pomeru <em>\u201enem\u00f4\u017ee predstavova\u0165 absol\u00fatnu prek\u00e1\u017eku v neskor\u0161om konan\u00ed na ochranu osobnosti pri zis\u0165ovan\u00ed, \u010di tak\u00fdmto d\u00f4vodom bolo po\u017e\u00edvanie alkoholick\u00fdch n\u00e1pojov u zamestnanca.\u201c<\/em><\/p>\n<p>Ak sa teda s\u00fady ni\u017e\u0161ej in\u0161tancie odmietli zaobera\u0165 d\u00f4kazmi navrhnut\u00fdmi \u017ealovanou, smeruj\u00facimi pod\u013ea jej n\u00e1zoru k preuk\u00e1zaniu pravdivosti sporn\u00e9ho v\u00fdroku, <em>\u201epotom rezignovali na svoju funkciu objekt\u00edvneho arbitra sporu a na z\u00e1klade neprimeran\u00e9ho formalizmu v procese zis\u0165ovania skutkov\u00e9ho stavu odmietli spravodlivos\u0165.\u201c<\/em><\/p>\n<p>S\u00a0pouk\u00e1zan\u00edm na rozhodovaciu prax \u00dastavn\u00e9ho s\u00fadu SR a\u00a0na \u0148u nadv\u00e4zuj\u00face predch\u00e1dzaj\u00face rozhodnutia Najvy\u0161\u0161ieho s\u00fadu SR (sp. zn.\u00a0<a href=\"https:\/\/www.epi.sk\/form\/goto.ashx?t=40&amp;p=19281935&amp;f=2\">4Cdo\/100\/2018<\/a> a\u00a0sp. zn. 5Cdo\/151\/2019) najvy\u0161\u0161\u00ed s\u00fad op\u00e4tovne zd\u00f4raznil, \u017ee nevyhovenie d\u00f4kazn\u00e9mu n\u00e1vrhu strany sporu mo\u017eno od\u00f4vodni\u0165 len tromi d\u00f4vodmi. <em>\u201ePrv\u00fdm je argument, pod\u013ea ktor\u00e9ho tvrden\u00e1 skuto\u010dnos\u0165, ktor\u00fa m\u00e1 navrhnut\u00fd d\u00f4kaz overi\u0165 alebo vyvr\u00e1ti\u0165, je bez relevantnej s\u00favislosti s predmetom konania. \u010eal\u0161\u00edm je argument, pod\u013ea ktor\u00e9ho d\u00f4kaz neover\u00ed\/nevyvr\u00e1ti tvrden\u00fa skuto\u010dnos\u0165, \u010di\u017ee vo v\u00e4zbe na toto tvrdenie nedisponuje vypovedacou potenciou. Nakoniec tret\u00edm argumentom je nadbyto\u010dnos\u0165 d\u00f4kazu, t. j. argument, pod\u013ea ktor\u00e9ho ur\u010dit\u00e9 tvrdenie, ku ktor\u00e9mu overeniu alebo vyvr\u00e1teniu je d\u00f4kaz navrhovan\u00fd, bolo u\u017e doteraj\u0161\u00edm konan\u00edm bez d\u00f4vodn\u00fdch pochybnost\u00ed overen\u00e9 alebo vyvr\u00e1ten\u00e9. Ak tieto d\u00f4vody zisten\u00e9 neboli, s\u00fad postupuje v rozpore s\u00a0<\/em><a href=\"https:\/\/www.epi.sk\/form\/goto.ashx?t=27&amp;p=2108583&amp;f=3\"><em>\u010dl. 46 ods. 1<\/em><\/a><em>\u00a0a\u00a0<\/em><a href=\"https:\/\/www.epi.sk\/form\/goto.ashx?t=27&amp;p=2108594&amp;f=3\"><em>\u010dl. 48 ods. 2 \u00dastavy SR<\/em><\/a><em>, ktor\u00e9 garantuj\u00fa pre stranu sporu \u00fastavn\u00e9 pr\u00e1vo na spravodliv\u00fd proces, \u010di\u017ee t\u00e1to d\u00f4kazn\u00e1 vada (tzv. opomenut\u00e9 d\u00f4kazy) takmer v\u017edy zalo\u017e\u00ed nielen nepresk\u00famate\u013enos\u0165 vydan\u00e9ho rozhodnutia pre nedostatok d\u00f4vodov, ale s\u00fa\u010dasne tie\u017e jeho proti\u00fastavnos\u0165.\u201c<\/em><\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; Najvy\u0161\u0161\u00ed s\u00fad SR sa v\u00a0rozhodnut\u00ed zo d\u0148a 28.10.2020, sp. zn. 7Cdo\/205\/2019, op\u00e4tovne vyjadril k\u00a0ot\u00e1zke, ak\u00fdmi d\u00f4vodmi mo\u017eno zo strany s\u00fadu zd\u00f4vodni\u0165 nevyhovenie d\u00f4kazn\u00e9mu n\u00e1vrhu jednej zo str\u00e1n sporu.
