Pod\u013ea tohto rozhodnutia sa pr\u00e1vny n\u00e1zor s\u00fadu aplikuje aj retrospekt\u00edvne, teda do minulosti.\u00a0 S\u00fad vych\u00e1dza zo skuto\u010dnosti, \u017ee pr\u00e1vo netvor\u00ed, ale iba nach\u00e1dza. <em>\u201eAk teda ide o\u00a0zmenu judikat\u00fary bez zmeny pr\u00e1vnej normy, nejde o zmenu pr\u00e1vneho pravidla. St\u00e1le ide o t\u00fa ist\u00fa pr\u00e1vnu normu, iba je nanovo vyjadren\u00fd jej obsah. Z toho vypl\u00fdva, \u017ee \u00fa\u010dinky zmeny judikat\u00fary nemo\u017eno obmedzi\u0165 len do bud\u00facnosti.\u201c<\/em><\/p>\n<p>Ak by s\u00fad aplikoval opa\u010dn\u00fd v\u00fdklad, teda \u017ee judikat\u00faru nemo\u017eno aplikova\u0165 retrospekt\u00edvne, prakticky by vedome aplikoval nespr\u00e1vny, u\u017e judikat\u00farou prekonan\u00fd pr\u00e1vny n\u00e1zor. <strong>Nov\u00fd pr\u00e1vny n\u00e1zor je vzh\u013eadom na to potrebn\u00e9 aplikova\u0165 aj na v\u0161etky u\u017e prebiehaj\u00face konania.<\/strong><\/p>\n<p>V\u00a0predmetnom konan\u00ed s\u00fad posudzoval (ne)platnos\u0165 zmluvy o\u00a0prevode vlastn\u00edckeho pr\u00e1va k\u00a0nehnute\u013enosti. Vlastn\u00edk (v \u010dase konania u\u017e neboh\u00fd), previedol vlastn\u00edctvo bytu na tretiu osobu (s inici\u00e1lami C. H.), ktor\u00e1 n\u00e1sledne byt predala \u017ealovan\u00fdm. Syn neboh\u00e9ho na s\u00fade napadol platnos\u0165 zmluvy o\u00a0prevode vlastn\u00edckeho pr\u00e1va k\u00a0bytu na \u017ealovan\u00fdch, a\u00a0to z\u00a0d\u00f4vodu \u00fadajnej du\u0161evnej poruchy zomrel\u00e9ho, ktor\u00e1 ho mala robi\u0165 na dan\u00fd \u00fakon nesp\u00f4sobil\u00fdm.<\/p>\n<p>Ke\u010f\u017ee odvolac\u00ed s\u00fad sa po zhodnoten\u00ed znaleck\u00e9ho dokazovania priklonil k\u00a0z\u00e1verom t\u00fdch znaleck\u00fdch posudkov, ktor\u00e9 deklarovali tak\u00fa du\u0161evn\u00fa poruchu zomrel\u00e9ho, ktor\u00e1 ho robila na dan\u00fd pr\u00e1vny \u00fakon (uzatvorenie zmluvy) neschopn\u00fdm, museli posudzova\u0165 aj ot\u00e1zku mo\u017enosti nadobudnutia vlastn\u00edckeho pr\u00e1va od nevlastn\u00edka, teda mo\u017en\u00e9 prelomenie z\u00e1sady \u201enemo plus iuris\u201c.<\/p>\n<p>Pri posudzovan\u00ed tejto ot\u00e1zky odvolac\u00ed s\u00fad pouk\u00e1zal na n\u00e1lez \u00dastavn\u00e9ho s\u00fadu Slovenskej republiky zo 16. marca 2016, sp. zn. I. \u00daS 549\/2015, pod\u013ea ktor\u00e9ho v\u00a0pr\u00edpadoch, ke\u010f sa dost\u00e1vaj\u00fa do vz\u00e1jomnej kol\u00edzie \u00fastavn\u00fd princ\u00edp ochrany dobrej viery \u010fal\u0161ieho nadob\u00fadate\u013ea (princ\u00edp dobrej viery, d\u00f4very v akty \u0161t\u00e1tu a pr\u00e1vnej istoty v demokratickom pr\u00e1vnom \u0161t\u00e1te) a\u00a0\u00fastavn\u00fd princ\u00edp ochrany vlastn\u00edckeho pr\u00e1va p\u00f4vodn\u00e9ho vlastn\u00edka (princ\u00edp nemo plus iuris ad alium transfere potest quam ipse habet) a\u00a0v\u00a0pr\u00edpadoch, ke\u010f nemo\u017eno zachova\u0165 maximum z obidvoch z\u00e1kladn\u00fdch pr\u00e1v<em>, \u201etreba prihliadnu\u0165 na princ\u00edp v\u0161eobecnej spravodlivosti, ke\u010f je nutn\u00e9 zva\u017eova\u0165 v\u0161eobecn\u00e9 s\u00favislosti tohto typu kol\u00edzie z\u00e1kladn\u00fdch pr\u00e1v, ako aj individu\u00e1lne okolnosti konkr\u00e9tneho rozhodovan\u00e9ho pr\u00edpadu.\u00a0<strong>Vy\u0161\u0161ie riziko m\u00e1 nies\u0165 nedbal\u00fd vlastn\u00edk ne\u017e nadob\u00fadate\u013e v dobrej viere, preto\u017ee tento nie je schopn\u00fd sa nijako dozvedie\u0165 o tom, ako vec opustila vlastn\u00edkovu sf\u00e9ru a dostala sa na list vlastn\u00edctva prevodcu po z\u00e1konom ur\u010denom spr\u00e1vnom (katastr\u00e1lnom) konan\u00ed<\/strong>.\u201c<\/em><\/p>\n<p>Odvolac\u00ed s\u00fad bol toho n\u00e1zoru, \u017ee v\u00a0danom pr\u00edpade je potrebn\u00e9 uprednostni\u0165 ochranu dobrej viery \u017ealovan\u00fdch pred ochranou vlastn\u00edckeho pr\u00e1va neboh\u00e9ho. Pouk\u00e1zal na to, \u017ee \u017ealovan\u00ed neboh\u00e9ho nepoznali a\u00a0preto sa nemali odkia\u013e dozvedie\u0165 o okolnostiach, za ktor\u00fdch sa \u201evlastn\u00edkom\u201c sporn\u00e9ho bytu stal C. H. \u017dalovan\u00ed tie\u017e predmetn\u00fd byt kupovali prostredn\u00edctvom realitnej kancel\u00e1rie, ktor\u00e1 ich ubezpe\u010dila, \u017ee C. H. je na pr\u00edslu\u0161nom liste vlastn\u00edctva zap\u00edsan\u00fd ako vlastn\u00edk sporn\u00e9ho bytu. Z\u00e1rove\u0148, \u017ealobca ako syn neboh\u00e9ho sa o neho nikdy nezauj\u00edmal a nikdy ho v zdravotn\u00edckom zariaden\u00ed nenav\u0161t\u00edvil. A\u00a0preto aj napriek neplatnosti zmluvy o prevode vlastn\u00edctva bytu nebolo mo\u017en\u00e9 \u017ealobe vyhovie\u0165 a \u017ealovan\u00ed sa stali vlastn\u00edkmi sporn\u00e9ho bytu v\u00a0d\u00f4sledku svojej dobromyse\u013enosti pri jeho k\u00fape.<\/p>\n<p>Najvy\u0161\u0161\u00ed s\u00fad sa v\u0161ak s\u00a0pr\u00e1vnym n\u00e1zorom odvolacieho s\u00fadu nestoto\u017enil. Kon\u0161tatoval, \u017ee okolnosti, z\u00a0ktor\u00fdch odvolac\u00ed s\u00fad svoj pr\u00e1vny z\u00e1ver odvodzuje, nie s\u00fa sp\u00f4sobil\u00e9 <em>\u201enaplni\u0165 ani pr\u00edpadn\u00fa po\u017eadovan\u00fa mieru v\u0161eobecnej spravodlivosti na prelomenie z\u00e1sady \u201enemo plus iuris\u201c<\/em>. Zalo\u017ei\u0165 rozhodnutie <em>\u201ev podstate na jednozna\u010dnej preferencii princ\u00edpu \u201ebona fides\u201c, odvol\u00e1vaj\u00fac sa v z\u00e1sadnom len na vieru v z\u00e1pis do katastra nehnute\u013enosti, podporne na ubezpe\u010denie \u010fal\u0161\u00edch nadob\u00fadate\u013eov od realitnej kancel\u00e1rie a prekvapuj\u00faco i nedostato\u010dn\u00fdm z\u00e1ujmom opr\u00e1vnenej osoby (syna) o zomrel\u00e9ho p\u00f4vodn\u00e9ho vlastn\u00edka\u201c<\/em> nie je mo\u017en\u00e9.<\/p>\n<p>Dovolac\u00ed s\u00fad z\u00e1rove\u0148 pouk\u00e1zal na to, \u017ee v ot\u00e1zke prelomenia z\u00e1sady \u201enemo plus iuris\u201c a s t\u00fdm s\u00favisiaceho nadobudnutia vlastn\u00edckeho pr\u00e1va od nevlastn\u00edka na z\u00e1klade dobrej viery nadob\u00fadate\u013ea, <strong>do\u0161lo v \u010dase po podan\u00ed predmetn\u00e9ho dovolania k ust\u00e1leniu rozhodovacej praxe dovolacieho s\u00fadu a to prostredn\u00edctvom uznesenia ve\u013ek\u00e9ho sen\u00e1tu obchodnopr\u00e1vneho kol\u00e9gia z 27. apr\u00edla 2021 sp. zn. 1VObdo\/2\/2020.<\/strong><\/p>\n<p>K\u00a0prelomeniu z\u00e1sady nemo plus iuris v\u00a0prospech z\u00e1sady bona fides je potrebn\u00e9 pristupova\u0165 re\u0161trikt\u00edvne. A\u00a0s\u00edce:<\/p>\n<ul>\n<li>na z\u00e1klade absol\u00fatne neplatn\u00e9ho pr\u00e1vneho \u00fakonu nie je mo\u017en\u00e9 nadobudn\u00fa\u0165 vlastn\u00edcke pr\u00e1vo, a to ani v pr\u00edpade, \u017ee na jeho podklade bol uskuto\u010dnen\u00fd vklad vlastn\u00edckeho pr\u00e1va do katastra nehnute\u013enost\u00ed;<\/li>\n<li>s poukazom na pr\u00e1vnu z\u00e1sadu, pod\u013ea ktorej nikto nem\u00f4\u017ee previes\u0165 na in\u00e9ho viac pr\u00e1v, ako s\u00e1m m\u00e1, nem\u00f4\u017ee platne previes\u0165 vlastn\u00edcke pr\u00e1vo k nehnute\u013enosti na in\u00fa osobu ten, kto je na z\u00e1klade absol\u00fatne neplatn\u00e9ho pr\u00e1vneho \u00fakonu veden\u00fd v katastri nehnute\u013enost\u00ed ako vlastn\u00edk nehnute\u013enost\u00ed;<\/li>\n<li>dobr\u00e1 viera nadob\u00fadate\u013ea, \u017ee hnute\u013en\u00fa alebo nehnute\u013en\u00fa vec nadob\u00fada od vlastn\u00edka, m\u00e1 vplyv na nadobudnutie vlastn\u00edckeho pr\u00e1va, <strong>len pokia\u013e z\u00e1kon v taxat\u00edvne vymedzen\u00fdch pr\u00edpadoch nadobudnutie vlastn\u00edckeho pr\u00e1va s poukazom na dobr\u00fa vieru ich nadob\u00fadate\u013ea v\u00fdslovne upravuje. V in\u00fdch pr\u00edpadoch pr\u00e1vna \u00faprava de lege lata nadobudnutie vlastn\u00edckeho pr\u00e1va od nevlastn\u00edka s poukazom na dobr\u00fa vieru nadob\u00fadate\u013ea neumo\u017e\u0148uje<\/strong>;<\/li>\n<li>Ustanoveniu \u00a7 70 ods. 1 z\u00e1kona \u010d. 162\/1995 Z. z. o katastri nehnute\u013enost\u00ed a o z\u00e1pise vlastn\u00edckych a\u00a0in\u00fdch pr\u00e1v k nehnute\u013enostiam (katastr\u00e1lny z\u00e1kon), ktor\u00e9 upravuje hodnovernos\u0165 \u00fadajov katastra, nezodpoved\u00e1 v\u00fdklad, pod\u013ea ktor\u00e9ho u\u017e len sama evidencia vlastn\u00edctva nehnute\u013enosti v katastri nehnute\u013enosti zaklad\u00e1 dobr\u00fa vieru evidovan\u00e9ho vlastn\u00edka v to, \u017ee je vlastn\u00edk.<\/li>\n<\/ul>\n<p>Pre \u00faplnos\u0165 uv\u00e1dzame, \u017ee pod\u013ea bodu 72 vy\u0161\u0161ie uveden\u00e9ho uznesenia ve\u013ek\u00e9ho sen\u00e1tu sp. zn. 1VObdo\/2\/2020, medzi in\u00e9 skuto\u010dnosti ustanoven\u00e9 z\u00e1konom, na z\u00e1klade ktor\u00fdch mo\u017eno nadobudn\u00fa\u0165 vlastn\u00edcke pr\u00e1vo k veci pod\u013ea \u00a7 132 ods. 1 Ob\u010dianskeho z\u00e1konn\u00edka<a href=\"#_ftn1\" name=\"_ftnref1\">[1]<\/a>, <strong>nie je mo\u017en\u00e9 zaradi\u0165 nadobudnutie veci v dobrej viere od nevlastn\u00edka vo v\u0161eobecnosti<\/strong> (t. j. okrem pr\u00edpadov v\u00fdslovne predpokladan\u00fdch z\u00e1konom). Pod\u013ea bodu 73 uveden\u00e9ho uznesenia \u201e<em>v\u00fdnimky zo z\u00e1sady nemo plus iuris, uprednost\u0148uj\u00face ochranu dobromyse\u013en\u00e9ho nadob\u00fadate\u013ea, s\u00fa taxat\u00edvne upraven\u00e9 naprie\u010d jednotliv\u00fdmi pr\u00e1vnymi predpismi.\u201c <\/em><strong>Medzi uveden\u00e9 v\u00fdnimky mo\u017eno zaradi\u0165 tieto z\u00e1konn\u00e9 ustanovenia<\/strong>:<\/p>\n<ul>\n<li>Neopr\u00e1vnen\u00fd dedi\u010d pod\u013ea \u00a7 486 Ob\u010dianskeho z\u00e1konn\u00edka:<em> \u201e<\/em><em>Kto dobromyse\u013ene nie\u010do nadobudol od neprav\u00e9ho dedi\u010da, ktor\u00e9mu bolo dedi\u010dstvo potvrden\u00e9, je chr\u00e1nen\u00fd tak, ako keby to bol nadobudol od opr\u00e1vnen\u00e9ho dedi\u010da.\u201c<\/em><\/li>\n<li>Obchodnopr\u00e1vne vz\u0165ahy pod\u013ea \u00a7 446 Obchodn\u00e9ho z\u00e1konn\u00edka:<em> \u201eKupuj\u00faci nadob\u00fada vlastn\u00edcke pr\u00e1vo aj v pr\u00edpade, ke\u010f pred\u00e1vaj\u00faci nie je vlastn\u00edkom pred\u00e1van\u00e9ho tovaru, iba\u017ee v \u010dase, ke\u010f kupuj\u00faci mal vlastn\u00edcke pr\u00e1vo nadobudn\u00fa\u0165, vedel, \u017ee pred\u00e1vaj\u00faci nie je vlastn\u00edkom a \u017ee nie je ani opr\u00e1vnen\u00fd s tovarom naklada\u0165 za \u00fa\u010delom jeho predaja.\u201c<\/em><\/li>\n<li>Konkurzn\u00e9 konanie pod\u013ea \u00a7 93 ods. 3 z\u00e1kona o\u00a0konkurze a\u00a0re\u0161trukturaliz\u00e1cii:<em> \u201eKupuj\u00faci pri odplatnom prevode veci zap\u00edsanej do s\u00fapisu nadobudne vlastn\u00edcke pr\u00e1vo aj vtedy, ke\u010f \u00fapadca nebol vlastn\u00edkom tejto veci, iba\u017ee vedel alebo musel vedie\u0165, \u017ee \u00fapadca alebo tretia osoba, ktorej majetok zabezpe\u010duje z\u00e1v\u00e4zok \u00fapadcu, nie je vlastn\u00edkom veci.
