In\u00fdmi slovami, Ve\u013ek\u00fd sen\u00e1t Najvy\u0161\u0161ieho s\u00fad SR rozhodoval o\u00a0tom, \u010di k\u00a0vydr\u017eaniu pozemku m\u00f4\u017ee d\u00f4js\u0165 aj v\u00a0situ\u00e1cii, ak dr\u017eite\u013e nadobudol\/u\u017e\u00edval nehnute\u013enos\u0165 na z\u00e1klade k\u00fapnej zmluvy uzatvorenej \u00fastne, hoci pr\u00e1vny predpis k\u00a0jej platn\u00e9mu uzatvoreniu vy\u017eaduje p\u00edsomn\u00fa formu.<\/p>\n<p>Najvy\u0161\u0161\u00ed s\u00fad tak v\u00a0z\u00e1sade rozhodoval o\u00a0tom, \u010di v\u0161eobecne platn\u00e1 pr\u00e1vna z\u00e1sada <em>\u201eNeznalos\u0165 z\u00e1kona neospravedl\u0148uje\u201c<\/em> br\u00e1ni tomu, \u010di dr\u017eite\u013e mohol by\u0165 <em>\u201eso zrete\u013eom na v\u0161etky okolnosti dobromyse\u013en\u00fd\u201c<a href=\"#_ftn1\" name=\"_ftnref1\"><strong>[1]<\/strong><\/a><\/em> ak mal vedie\u0165, \u017ee k\u00a0platn\u00e9mu prevodu vlastn\u00edckeho pr\u00e1va je nevyhnutn\u00e1 p\u00edsomn\u00e1 forma k\u00fapnej zmluvy.<\/p>\n<p>Najvy\u0161\u0161\u00ed s\u00fad najprv zhrnul svoju doteraj\u0161iu judikat\u00faru nastolenej pr\u00e1vnej ot\u00e1zky, pri\u010dom pouk\u00e1zal na skuto\u010dnos\u0165, \u017ee jej v\u00fdvoj sa naozaj uberal dvomi protichodn\u00fdmi smermi.<\/p>\n<p>V star\u0161ej judikat\u00fare NS SR (R 44\/96 &#8211; rozsudok z 28. febru\u00e1ra 1995 sp. zn. 3Cdo\/117\/94) rozli\u0161oval medzi ochranou vlastn\u00edctva a ochranou dr\u017eby a\u00a0pouk\u00e1zal pri tom aj na skor\u0161iu judikat\u00faru (R 45\/1986) pod\u013ea ktorej <em>\u201ena rozdiel od preukazovania vlastn\u00edctva nebude treba, aby nadob\u00fadate\u013e preukazoval platn\u00fd pr\u00e1vny d\u00f4vod nadobudnutia &#8211; riadny prechod vlastn\u00edctva, ale len okolnosti sved\u010diace o poctivosti nadobudnutia, v tom je z\u00e1kladn\u00fd rozdiel medzi ochranou vlastn\u00edctva a ochranou dr\u017eby\u201c.<\/em> Pod\u013ea pr\u00e1vnej vety R 44\/96 <em>\u201eneplatnos\u0165 pr\u00e1vneho \u00fakonu o prevode vlastn\u00edctva nie je okolnos\u0165ou vylu\u010duj\u00facou nadobudnutie vlastn\u00edctva vydr\u017ean\u00edm\u201c. <\/em><\/p>\n<p>Pribli\u017ene od roku 2010 sa rozhodnutia najvy\u0161\u0161ieho s\u00fadu za\u010dal ubera\u0165 in\u00fdm smerom. Najvy\u0161\u0161\u00ed s\u00fad viacer\u00fdmi rozhodnutiami, napr. 4Cdo\/283\/2009 (R 73\/2015), 4Cdo\/361\/2012 (R 74\/2015), 5Cdo\/49\/2010, 3Cdo\/97\/2009, 3MCdo\/7\/2010, 3MCdo\/8\/2010, 2Cdo\/207\/2005, \u010di 6MCdo\/5\/2010, priklonil k n\u00e1zoru, \u017ee do podmienok opr\u00e1vnenej dr\u017eby, teda aj dobromyse\u013en\u00e9ho dr\u017eite\u013ea, je potrebn\u00e9 zahrn\u00fa\u0165 aj povinnos\u0165 dr\u017eite\u013ea dodr\u017ea\u0165 pr\u00e1vny titul potrebn\u00fd pre nadobudnutie vlastn\u00edckeho pr\u00e1va.<\/p>\n<p>Ve\u013ek\u00fd sen\u00e1t kon\u0161tatuje, \u017ee re\u0161trikt\u00edvny pr\u00e1vny n\u00e1zor najvy\u0161\u0161ieho s\u00fadu, pod\u013ea ktor\u00e9ho dr\u017eite\u013e nem\u00f4\u017ee by\u0165 dobromyse\u013en\u00fd v\u00a0pr\u00edpade prevodu nehnute\u013enosti \u00fastnou k\u00fapnou zmluvou, sa za\u010dal uplat\u0148ova\u0165 bez <em>\u201e<\/em><em>z\u00e1sadn\u00e9ho zd\u00f4vodnenia zmeny star\u0161ej judikat\u00fary, bez zmeny pr\u00e1vnej \u00fapravy, \u010di bez spolo\u010denskej zmeny, alebo v n\u00e1zore pr\u00e1vnej vedy, reflektuj\u00fac sk\u00f4r \u010desk\u00fa judikat\u00faru (s rozdielnym historick\u00fdm pr\u00e1vnym z\u00e1zem\u00edm)\u201c<\/em>. Tento \u201ere\u0161trikt\u00edvny\u201c pr\u00e1vny n\u00e1zor NS SR (takto ho ozna\u010duje ve\u013ek\u00fd sen\u00e1t) sa opieral o\u00a0argument, \u017ee <em>\u201edr\u017eite\u013e nem\u00f4\u017ee by\u0165 dobromyse\u013en\u00fd v pr\u00edpade prevodu nehnute\u013enosti \u00fastnou k\u00fapnou zmluvou, ak pr\u00e1vny poriadok vy\u017eaduje na prevod nehnute\u013enosti p\u00edsomn\u00fa k\u00fapnu zmluvu\u201c<\/em>, preto\u017ee pod\u013ea n\u00e1zoru NS SR <em>\u201ei\u0161lo toti\u017e o neospravedlnite\u013en\u00fd pr\u00e1vny omyl\u201c<\/em>.<\/p>\n<p>Ve\u013ek\u00fd sen\u00e1t najvy\u0161\u0161ieho s\u00fadu \u010falej pouk\u00e1zal na historick\u00fd kontext vydr\u017eania. <em>\u201eDr\u017eba je historicky ch\u00e1pan\u00e1 ako faktick\u00fd stav, ktor\u00fd spo\u010d\u00edva vo vykon\u00e1van\u00ed faktickej re\u00e1lnej moci nad vecou s \u00famyslom ma\u0165 vec pre seba. <strong>Dr\u017eba preto predpoklad\u00e1 existenciu dvoch zlo\u017eiek.<\/strong> <strong>Prvou je corpus possesionis, ako faktick\u00e1 moc nad vecou<\/strong>, <strong>ku ktorej mus\u00ed prist\u00fapi\u0165 animus possidendi, ktor\u00fd vyjadruje v\u00f4\u013eu dr\u017eite\u013ea ma\u0165 vec (pr\u00e1vo) pre seba a naklada\u0165 s \u0148ou ako s vlastnou.<\/strong> Vznik dr\u017eby sa v\u0161ak na rozdiel od vzniku vlastn\u00edctva nemus\u00ed de lege lata nutne opiera\u0165 o existuj\u00faci pr\u00e1vny d\u00f4vod. Inak povedan\u00e9 <strong>na vznik opr\u00e1vnenej dr\u017eby posta\u010d\u00ed naplnenie z\u00e1konn\u00fdch predpokladov dr\u017eby, medzi ktor\u00fdmi sa existencia pr\u00e1vneho d\u00f4vodu nenach\u00e1dza.\u201c <\/strong><\/em><\/p>\n<p>Pr\u00e1vne predpisy v\u00fdraz \u201edobromyse\u013en\u00fd\u201c nevymedzuj\u00fa, preto v\u00fdchodiskom \u010fal\u0161\u00edch \u00favah mus\u00ed by\u0165 jeho v\u00fdznam v be\u017enej re\u010di. S\u00a0poukazom na gramatick\u00fd v\u00fdklad dobromyse\u013enosti najvy\u0161\u0161\u00ed s\u00fad uviedol, \u017ee <em>\u201edr\u017eite\u013e je dobromyse\u013en\u00fd o tom, \u017ee mu vec patr\u00ed vtedy, ke\u010f je poctiv\u00fd, \u010destn\u00fd o tom, \u017ee svojou dr\u017ebou vykon\u00e1va vlastn\u00e9 pr\u00e1vo, a teda \u017ee svojou dr\u017ebou nerob\u00ed in\u00e9mu zle, \u017ee nezasahuje do pr\u00e1va in\u00e9ho, \u017ee nekon\u00e1 bezpr\u00e1vne &#8230; S\u00fad sa v r\u00e1mci sk\u00famania ot\u00e1zky dobromyse\u013enosti zameriava na sk\u00famanie poctivosti konania dr\u017eite\u013ea z objekt\u00edvneho h\u013eadiska a nie na sk\u00famanie (ne)existencie pr\u00e1vneho titulu.\u201c<\/em><\/p>\n<p>Ve\u013ek\u00fd sen\u00e1t najvy\u0161\u0161ieho s\u00fadu tie\u017e pouk\u00e1zal na to, \u017ee judikat\u00f3rna l\u00ednia reprezentovan\u00e1 nov\u0161\u00edmi rozhodnutiami R 73\/2015 a R 74\/2015 je tie\u017e v rozpore so z\u00e1merom z\u00e1konodarcu reformou pr\u00e1vnej \u00fapravy vydr\u017eania v roku 1950 a\u00a01982 <em>\u201espru\u017eni\u0165 a u\u013eah\u010di\u0165 vydr\u017eanie\u201c<\/em> a <em>\u201eochr\u00e1ni\u0165 tzv. nedolo\u017een\u00e9 pr\u00e1vne vz\u0165ahy k\u00a0nehnute\u013enostiam\u201c. \u00a0<\/em>Ve\u013ek\u00fd sen\u00e1t tak vyjadril nes\u00fahlas s\u00a0argumenta\u010dnou l\u00edniu vyjadrenou v\u00a0rozhodnutiach R 73\/2015 a R 74\/2015, pod\u013ea ktor\u00fdch <em>\u201eneznalos\u0165 jasn\u00e9ho, zrozumite\u013en\u00e9ho a nesporn\u00e9ho ustanovenia z\u00e1kona neospravedl\u0148uje \u2013 pri zachovan\u00ed obvyklej opatrnosti sa toti\u017e predpoklad\u00e1, \u017ee ka\u017ed\u00fd sa obozn\u00e1mi so z\u00e1konnou \u00fapravou pr\u00e1vneho \u00fakonu, ktor\u00fd m\u00e1 v \u00famysle urobi\u0165\u201c. <\/em><\/p>\n<p>&nbsp;<\/p>\n<p><strong><em>Pr\u00e1vna veta:<\/em><\/strong><\/p>\n<p><strong><em>Pr\u00e1vny titul je len jedn\u00fdm z d\u00f4kazov preukazuj\u00facich dobromyse\u013enos\u0165 dr\u017eite\u013ea a opr\u00e1vnenos\u0165 dr\u017eby, preto jeho nedostatok pre \u00fa\u010dely vydr\u017eania s\u00e1m o sebe nem\u00f4\u017ee zapr\u00ed\u010dini\u0165 neopr\u00e1vnenos\u0165 dr\u017eby. Rozhoduj\u00facim v\u017edy bude, \u010di dr\u017eite\u013e konal poctivo, teda napr. \u010di za dr\u017ean\u00fa vec zaplatil dohodnut\u00fa sumu, pr\u00edpadne poskytol in\u00e9 dohodnut\u00e9 plnenie alebo preuk\u00e1zate\u013ene i\u0161lo o dar ako bezodplatn\u00e9 plnenie.<\/em><\/strong><\/p>\n<p><strong><em>\u00a0<\/em><\/strong><\/p>\n<p>Rozhodnutie Ve\u013ek\u00e9ho sen\u00e1tu Najvy\u0161\u0161ieho s\u00fadu SR je publikovan\u00e9 v\u00a0Zbierke stanov\u00edsk najvy\u0161\u0161ieho s\u00fadu a\u00a0rozhodnut\u00ed s\u00fadov Slovenskej republiky \u010d. 2\/2024 ako rozsudok z 13. m\u00e1ja 2024 sp. zn. 1VCdo\/1\/2024. Ide pritom o\u00a0jedin\u00e9 rozhodnutie publikovan\u00e9 v tejto\u00a0zbierke.
